This Network Rail Version of the Infrastructure Conditions of Contract Measurement Version incorporating NR8 Track amendments includes bespoke amendments drafted specifically for Track previously contained in Network Rail’s NR8 amendments to the ICC Measurement Version.

The ICC Network Rail Measurement Version has been drafted in conjunction with Network Rail to ensure there is a clear standard contract designed for use on Network Rail’s new Plain Line contracts and to support their overall contract strategy for Track. The opportunity has been taken to refine and update the NR8 amendments that have been incorporated to ensure a contract designed to deliver efficiencies in resource and expenditure.

Amendments for the ICC Network Rail Measurement Version include:

•A significantly revised Definitions clause to accommodate the particular requirements for Track
•Replacement of the Engineer with an Employer’s Representative
•A payment process which, whilst complying with current legislation, reflects NR practice regarding interim payment and payment in the event of cancellation of Core or other Works
•Changed completion procedures
•Changes to the valuation process
•Track possessions and isolations
•Provisions relating to the Claims Allocation and Handling Agreement
•The sharing of cost information
•The dispute resolution process

This Version does not replace the Measurement Version and is specific to the Works mentioned herein.

ICC Measurement Version Guidance Notes August 2011 are not fully compatible with the NR8 Track Version
